Question: Employment and Labor - Maryland

Asked on 11/4/2009
Is there a law I should know that can help my appeal. At the hearing for denial of benefits.and if the employer doesnt show are they in default?
I was fired from my job. I applied for unemployment and the co stated I quit. I had a phone interview with a case worker, she called the employer and called me back to say they told her I quit and that I still had my job. Needless to say I never received a paycheck. I got letter denial sec 1001,1002,1002.1. I have a witness and can show numerous letters of false complaints they have placed. I refused to do something illegal and was replaced the new guy had already started when I was on vacation. They lied re a employee when she went to the hearing they didnt show she didnt get approved

If the employer doesn't show at the hearing, you get to tell your side of the story, including a witness if you have one, and that's it.  The hearing officer doesn't automatically rule in your favor, although it does work out that way fairly often.

I'd suggest going back to "work" once you get that hearing date, just to see what happens; either you do still have a job, or you'll be able to testify from that experience that you don't, and that the employer lied about you having quit.  And if you haven't gotten all the pay you've earned, that's a separate claim you can make against them, not with unemployment.
