Is it worth my time to take someone who hit me with no insurance, to small claims for damages?

It is likely not worth your time. When you sue someone, even in small claims court, there are costs involved for you. You have to consider the likelyhood that you could obtain financial recovery from someone if you were to prevail in a lawsuit. Someone who does not carry auto insurance probably does not have the means to satisfy a judgment, meaning pay you, if you were able to get a judgment through a lawsuit. If you have uninsured motorist coverage on your own auto insurance, this is the best way for you to go.
