If one receives a photo radar ticket in the mail is that considered binding? I was told that Arizona law requires that all complaints, including traffic tickets, be personally served. Then I was told to ignore the ticket. Is this true?
The best advice is to pay the ticket, but what you've heard is basically true. If you don't acknowledge the ticket in any way they have to personally serve you within a certain time period or the ticket will be dismissed. If they do effect personal service on you, then you will also be liable for the costs of service in addition to the ticket and court costs. So, it's really just a question of whether you're willing to roll the dice on dodging process servers for four months or so. Bear in mind that if you've got anyone at your house 18 years of age or older who answers the door, that counts as effective service of process on you.
