Is it possible to sue a county jail?
Question Details:
I got assaulted last year in jail and it re-injured my neck fusion. I went to the ER due to the fact that it's hard to swallow and turn my neck; the pain is unbearable. Can anyone help?
You *may* be able to sue your county jail. There are two main issues:
1) Was the jail (e.g. the guards) negligent in some way? For example, were they not supervising inmates properly? Did they leave you alone with someone who had made threats against you? Etc. If they did everything right, they might not be liable--people and institutions are liable (or have to pay) when they are at fault in how they acted, not merely because someone was injured.
2) There are typically very short timelines (called "statutes of limitations") in which to sue a state or country government or one of their agencies or institutions--it may already be too late.
Looking at 2), if you think the jail may have been liable or negligent, contact a lawyer NOW to discuss whether you could and should bring a lawsuit, because you do not want to delay any more.
