Question Details: When I was convicted, I was sentenced to 5 years of bench probation, but my lawyer said I could have it removed at 18 months if I kept my nose clean, which I have. When I called him again, he said, 'just keep minding the law, why bother, it doesn't hurt anything'. But, I want it over and done with, because of some immigration laws in a country I'm planning on visiting. So, IS it possible, and if so, HOW do I go about doing so?
Although I do not practice law in the State of Oregon, here are my initial impressions. I think that you should consult with another local attorney, to review this matter in greater detail. It sounds like your former attorney might have made a false promise to you to induce you to plead guilty. If this is true, and if you can prove this, then you may have remedies available to you both with respect to your conviction, and against your former attorney. A different attorney will be able to evaluate whether these options exist once you have had a chance to go deeper into the relevant facts. Good luck.
