Is it possible to file a suit for pain and suffering, emotional abuses, and mental anguish due to 24/7 stalking and threats of harm against me?
Question Details:
My neighbor is stalking me by car and by foot - slaming doors; watches my every move; greatly violates my privacy and peace. Brings her "friend" each time and threatens to harm me. They paced the stairs, my patio, taking pictures, pounding on my front door. They even said, "open the door, are you afraid of a woman"? I call the police several times and recently, twice in less than 24 hours. I got a T.R.O. against this neighbor but she works for a law firm so she's one tough violator/stalker. I don't know what to do except fear for my life.
Yes, you can sue her for harassment, trespassing, stalking, making threats...there are a number of different claims you could press against her, and once you retain an attorney (which you should do immediately, if you haven't done so yet), he or she can advise you on the exact claims you could bring and for how much.
However, protecting yourself is more important. Next time and every time she is on your property, call the police against her for trespassing; if possible, take pictures of her doing it (don't go outside; just through the window will be fine) so as to have evidence. Keep calling the police on her every time she threatens, trepasses, until the police start intervening.

Are you a lawyer?
