Is it possible for an attorney to postpone arraignment/court dates so that you get past the 7 year look-back period of your prior DUI conviction?
Question Details:
I need to make extend my court dates about 3 1/2 months so that I don't have 2 convictions in 7 years. Is that possible?
The look back period is a way that will certainly limit your exposure in a dwi case. However, the state's atty is well aware of the stature as is your lawyer. the state's atty is not going to let this happen. however, the states atty may not be concerned here becasue the state's atty is basing the time period for the look back on the date of the dwi and the last conviction. thus, if the date of the controls, which may be the case here, you continuing the date may not really help you. in other words, the state is looking at the date of the last conviction of the dui and then counting from the date of the most recent occurrence of the dwi. This is how the statute works in CT and I would be surprised if you could in fact delay the proceeding to get beyond the look back.
