Question Details: Someone I know is pregnant with her 7th child. She has had the first 6 taken away by CPS, due to **** problems. Her youngest son had his stomach pumped when he was born because his system was full of cocaine. Her newest daughter is fixing to have surgery November 3rd to have a birthmark removed. Due to the fact that she neglected to take the baby to the doctor and have him look at it.
I very much doubt it. Once upon a time, court-ordered sterilization was occasionally permitted, mostly for the severely retarded; in one famous Supreme Court opinion that continued to allow the practice, Justice Oliver Wendell Holmes wrote, "Three generations of imbeciles is enough."
Under today's law, I can't see a court ordering this, any more than a court could order a woman to get an abortion or to take birth control pills. On this woman's record, I could see CPS standing by at the hospital, to take custody of the baby right after birth, but that's about it.
