Is it legal for a seller of a property to sell a house that has a septic tank attached to it and not include the land that has that laterals on it or
Question Details: a well that is connected to the heating and air? The seller had originally planned a housing development on the surrounding property and claimed that he would be having city sewer installed and would hook the house to it. The development fell through and now he has sold the property that the laterals are on to another party. He also did not include adjacent land that contained a well that serviced the heat pump in the house/
I am a licensed KS attorney. I assume you have a written contract for sale. What did the contract say about the septic/sewer? Do you know what the buyer knew about this property? I would need more information, and I would need to see what sales contract you might have, to fully answer this question.
