Is it legal for a hospitol to bill you if they didn't get a claim filed in a timely manner, causing your insuranc company to deny a covered charge

Question Details: My son was in the hosptol Jan. 2008. I recieved a bill today saying the total amount was due because insurance denyed the claim because it was filed too late We had two insurnaces and it should have been covered completely. Is it legal for them to bill us for their mistake?

I am a lawyer in CT and practice in this area of the law.  The hospital certainly made a mistake.  however, you need to contact your insurance that was in place at the time to get this covered to the extent that the policy allows.  if the insurance company fails to honor the contract you can sue the insurance company for bad faith.  the medical bill however, is your responsibility as the hospital provided the services.  I suggest hiring a lawyer to get involved to talk to your insurance company and the hospital.
