Illegal prescriptions, especially of narcotics, are a felony. As for what kind of tort, since the person was in the medical profession and was presumably working under the aegis of a doctor, a practice, a clinic, or a hospital, it would be a medical malpractice claim against the employing medical professional or institution, plus either a medical mal or more traditional personal injury tort vs. the medical assistant.
