Wrongful Death - Accidental Death Law Answers

This can be both a criminal and civil matter.

If the family brings a medical malpractice civil suit they have that right and that's a civil action.

If the prosecutor decides to press charges those will be criminal and can also be done. Whether its a felony or misdemeanor depends on the circumstances and how the government decides to proceed. It can be charged as either and will rest in the hands of the prosecutor to decide if i fact they press charges.
