Validity of clause in contract that has not been initialed.

Question Details:

My realtor slipped a exclusive buyer-broker clause in an offer I put in on a home. I want to stop using her, but they are now holding this against me. I signed it but never initialed line 43 (the clause in question). Is the contract still valid?

In general a contract does not require every clause be initialled. If your did you will have the best chance to negate that line. However in general this should not be the case as your signing the contract as a whole acknowledged acceptance of the entire agreement. What I would advise is that you review the terms and speak with a local attorney who may be able to assist you in breaking that clause. If it is possible they will be able to best advise and assist you.
