Question Details: we owe our lawyer $3,500. he lent this money for us as an advance while waiting for our settlement. now we really have a hard time reaching for him. and as i remembered he told us that he cant do anything if the adjuster is not making an offer at all. we just wait. but i asked him what if the sdjuster will not make an offer anymore so we will wait for nothing?he answered nothing to worry because the papers were being reviewed already and it's more than a month now. can we hire new lawyer even if we owe him? can we file a complaint to the state insurance department? what else can we do? HELP
Unfortunately, under California law, there is no mechanism to force an insurance company to act swiftly or to act fairly. So it may take more than 30 days to get an offer. Even then, once you get the offer, you may not be happy - it may be too low. Although California law gives the client a right to fire a lawyer and hire a new lawyer, at any time, it may be hard to find a lawyer to take over your case. Good luck.

This story is rather unusual. It really does not make a lot of sense. It is hard to imagine an attorney not returning your phone calls after advancing money on a case. There are a number of possibilities here and none of them are good. I would rather not speculate.
You must immediately retain the services of another attorney to check up on this entire matter. Of course you can hire another attorney to assist you. That new attorney can assist you with the status of your claim and complete the process of your claim, if that is needed.
Filing a complaint with the insurance department is not the next step.
