Question: Divorce, Marriage, Alimony - Arkansas

Asked on 10/28/2009

Income taxes and husband/wife separation

I separated from my husband in April 2009 and I have not had any income for the 2009 tax year. Do I still have to file taxes at the end of the year and, if so, do I file married filing single? I'm so confused; thanks for all your help.

You should hire an attorney and file for divorce as soon as possible.  It's possible to get an order on file requiring you both to file married filing jointly so that you can take advantage of the marital deduction.  In essence, this would ensure a bigger tax return.  You would be entitled to part of that as marital income.  But you need to move quickly since the tax year is almost over.  Let me know if I can be of any assistance.
