DUI / DWI Law Answers

In all states a  DUI stays on your driving record forever.  However, some states have what is known as a "look-back period".  This is the time in which the court will look back into your driving record to see if you have any prior DUI's.  If you don't then your current DUI is treated as your first offense for sentencing purposes.

It used to be that Kansas had a look back period of 5 years.  This is no longer the case.  If you have had any prior convictions of DUI, this counts towards your Kansas DUI penalties, regardless of how long ago they were.

Bottom line, there is no look back period for DUI in Kansas.
