In a townhouse who is responsible for damage to the shared wall?

Question Details: I own a townhouse. The neighbor's water heater broke and began leaking through the wall shared by our homes causing wall and carpet damage. We do not have a home owner's association. Is my neighbor responsibile for the cost of repairing the water damage to my home?

If your neighbor is the owner of the home, then the neighbor is liable for the damage (cost of repairs) to your townhouse caused by the water heater. 

If the neighbor is only leasing the home, then the owner/landlord would be liable for the damage to your townhouse.
