What's my recourse if I was In a car accident and we agreed not to file a report or get insurers companies involved byt now the guy won't pay per our agreement?
Question Details: I have emails and text messages where this guy agrees that yes he was at fault and that he agreed to the terms of the payments to me for the entire cost of the damages. I have his license, car information, cell and email address. Can I sue him for the remainder, plus any additional monies required to do so (i.e. lawyer fees, or cost incurred in serving him papers or locating him/background checks), if he refuse to pay per our agreement?
Yes you can sue him. Your agreement is a valid contract and if the other party is not upholding their agreement per the contract, you can sue to enforce that agreement.
