If my nephew were to be taken away from my sister by CPS, would I be able to legally adopt him?

Under the laws of all states in this country the only way a person can legally adopt a minor is of the parent knowingly signs and adoption agreement subject to court approval allowing such which is typically prepared by a family law attorney.

Unless your sister is willing to allow the above then you cannot adopt her child.
