If I waive my request for reimbursement for administration costs from an estate, can I later reinstate my claim?
Question Details:
My administration costs are high because of travel (I was advised that the court would not likely approve them anyway). I am willing to wave my administration costs so my mom, the widow, will not be financially hurt as bad. However, if the attorney that represented me then raises his fees,(likely) I would rather it go to me? Can I revisit that once I have waved it?
Probably not. But I think you can list those expenses you're bearing yourself, and specify that in your accounting. You can say that you're doing it in the interest of the widow, and based on a standard of reasonableness, and ask that the attorney be held to the same standards. Don't make too big a deal of it, in your argument (written brief or letter, probably), but make sure the judge is aware of your waived expenses.
Sometimes, getting to the legal or moral "high ground" first is what wins the case. Waiving the travel expenses is the right thing to do, really, and it will make the court that much more willing to listen to what you have to say.
