If I was hit my an uninsured vehicle what rights do I have?

Question Details:

I was the passenger in a vehicle hit by an uninsured vehicle. I have received medical treatment, however I am being asked to pay for it myself out of my own pocket. I have my own auto insurance however don't reside where my vehicle is insured. My car was not involved and I am not receiving any benefits from the accident. What options do I have?

Make a claim with the host vehicle insurahce carrier

If the driver of the vehicle in which you were a passenger has uninsured motorist coverage, you can file a personal injury claim with that insurance carrier.  When you complete your medical treatment, the medical reports which document the nature and extent of your injuries will determine the amount of compensation you receive for pain and suffering.  The compensation for pain and suffering is in addition to compensation for your medical bills, wage loss and other expenses you have incurred.
