If I signed a contract with the consultant company which states I agree to Mediation/Arbitration can I still file a small claims suit against them?
Here's the clause in the contract: 19.) MEDIATION; ARBITRATION. Except with respect to XYZ Company's right to obtain injunctive relief as provided for in Section 16 above, if a dispute arises out of or relates to this Agreement, or the breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Rules. If the mediation is unsucessful, the matter shall be settled by arbitration

Typically these types of clauses are enforceable.  You would need to mediate and then arbitrate.
