If I have no insurance and got a DUI; if someone was at fault and collided with my car, do they still have to pay for my repairs?

Question Details:

I was turning right into my driveway, a man coming from behind hit me in the passenger side as I was turning in. I just wanted to know even though I had no insurance and had a DUI, is he still responsible since it was clearly his fault?

If the other driver is at fault, the other driver is liable for the property damage to your vehicle.  If you were cited for DUI in this particular incident, it may be difficult to prove the other driver was at fault.  If the DUI you are referring to was from a prior incident, unrelated to this present auto accident, then it is not a factor in determining liability in this present auto accident.

If you don't have auto insurance and are not at fault in an auto accident, the other driver is still liable.
