If i accept acheck from the ins company can I sue the guy that was at fault for the rest?

Question Details: My husband got in to a wreck and the other guy was deamed at fault but his Ins. company will only pay 2200.00 of a 6900.00 claim. so can he take what the ins company is offering and then sue the guy atfault for the rest?

If you accept a check from the insurance company as settlement of your case, you can't sue the other party for the balance of your claim.  In order to receive the settlement check from your insurance company, the insurance company will have you sign a release of liability which will contain language preventing you from suing the other party.
