If a sign left by a construction company falls into the road and damages my car, are they liable?

Question Details:

A road construction sign - over a year old - was left lying in the median under a freeway overpass. One of the metal brackets/polls must have been sticking out of the median and into the left lane just enough to clip the bottom left corner of my car as I passed it, catching in my grill and causing a great deal of damage to my car as I dragged it slowing down to a stop. Is the city liable? The construction company? Me?

Auto Accidents Law Answers

I am a lawyer in CT and practice in this area of the law.  I suggest that you write a letter to the construction company explaining what happened and get the car repaired and provide the construction company with the bill.  if the construction company fails to pay the bill, you should file a small claims complaint in court and tell your story to the judge.  the construction company will likely settle with you to avoid a court judgment.
