Question Details: I bumped another vehicle in a shopping center parking lot on 10/17. I left my contact information on the vehicle. The owner the other car called me back and left her name and number on 10/19. When I called her back on 10/20 I talked to her sister who told me the owner was taking the car to get it fixed on 10/22. If she is getting the repairs done before allowing me to contact my insurance with her information and estimates of the cost of the repairs am I responsible for the cost of the damages?
I am a lawyer in CT and practice in this area of the law. You are responsible for the damages, but the reasonableness of the price will be an issue. if the person takes the car to an expensive dealer then you will be paying a lot more than usual. I suggest that you find out the cost of the repairs and find out if the price was reasonable. The person was not required to let you take it to your insurance carrier, however, if you want to refuse to pay and make this person sue you for the damages and then let the court decide on a reasonable price to have you pay by comparing the estimate with another shop that is ok to do and may be a good way to get the person to compromise.
