If a person is terminated isn't the employer supposed to givethem their last paycheck?

In most states, the law is that upon termination, the employee is supposed to be given his or her last paycheck. In other states, the employer has a couple of days to get that check out, as well. You need to first verify the law in your state regarding last paychecks and when due and then file a complaint with the department of labor and/or sue your employer in small claims court for the amount owed.
