Can a collection agency take a warrant out on me?

Question Details:

A check I wrote was returned over a year ago. The business I wrote it to turned it over to collections agency. Now the collection agency says they are going to take a warrant out. Did the business take the proper steps in handling the situation ? And can the collection agency take a warrant out on me ?

I am a lawyer in CT and practice in this area of the law.  Writing a chewck that you know will not clear is against the law.  the state may prosecute you if they believe that they can prove you wrote the check to defraud someone.  this is likely not the case.  however, the services for which you paid with the check are still not paid.  therefore, the collection agency is coming after you to pay the debt.  the credit agency may report the bad check to the police but the police are the ones that decide whether to arrest you.  i suggest calling the colection agency and trying to resolve the debt.  if you are arrested, be sure to hire a lawyer.
