I would like to file bankrupcty

Question Details:

Its been a year-and-a-half since I last made payments to creditors. I was self employed until the housing market fell; unemployed for almost a year now and working part-time. My wife and Iare separating. Civil action coming against me from creditors.

You can go to this site:  http://www.uscourts.gov/bankruptcycourts.html.  It will explain the basics of bankruptcy and provide forms that you can fill out yourself.

You should be aware, however, to the extent that you and your wife have joint assets, she will be affected by your filing.  Additionally, unless you are living apart and are legally separated, in a situation where only one spouse files, the income and expenses of the non-filing spouse is required so that the court, the trustee and creditors can evaluate the household's income. Although, this in no way obligates your husband, either legally or financially.
