Can the child support be modified if I do not attend the hearing?

Question Details:

A hearing has been set to modify the amount of child support I pay. I am up-to-date on all payments as my wages are garnished. I will not be able to attend the hearing because I am currently assigned overseas.

It is never a good idea to ignore a legal hearing in which your rights are involved. If you do not attend a hearing the only evidence the Judge will hear will be that of the other side. You usually will not fare well under this scenario.

If you are assigned overseas make sure an attorney appears on your behalf. The matter may be able to be postponed if your presence would be necessary for a fair hearing.
