Unless you stopped short on thew highway, the person behind you was likely following you too closely.  following too closely is against the law.  Becasue the person hit you from behind the person is likely at fault for the vehilce.  While the person that hit you did not have car insurance, if you have insurance your insurance carrier will step into the shoes of the at fault driver.  this is known as uninsured motorist coverage.  therefore, regardless of whether the at fault driver has insurance, you may trigger your insurance to step in to compensate you.  i suggest that you call your insurance carrier and report the claim.  you will need to supply the insurance company with certain information; however, they shoudl pay you for the damages.  do not delay!
