I was not at fault in a car accident and I have made a claim with my insurance company, what is my next step?
Question Details:
My accident consisted of another driver turning a car to sharp and hit me in the front driver side bumper. My car is not drivable. I have claimed the accident on my insurance, what am i supposed to do now? The police report says that she HAS insurance, but also says that she didn't have a current card.
Under Kentucky law, your car insurance is required to pay the first $10,000 of medical expenses or lost wages (this is why it is called "no-fault" insurance). If you think your injuries may cause you to miss work for a prolonged period of time, you will want to consider reserving your benefits for payment of wage losses and, if available, have the medical expenses paid by your health insurance coverage. Wage losses will usually be paid at a maximum rate of $200 per week, unless you have purchased additional PIP (personal injury protection) coverage. Your question does not mention whether or not you or any passengers were injured in the collision, so I cannot provide more detailed information about the situation.
I strongly recommend that you consult with a lawyer if you have been injured, because many considerations need to be given to this situation to protect your interests in receiving fair compensation.

Do you want to sue the other person? I.e. are you injured with significant medical bills, beyond any payment you get from your insurer? Have you lost income or suffered disability? Do you not have collision insurance, so that you need to recover the cost to repair your car (or replace it) from the other party? If you have economic loss that will not be covered by your insurer, you may wish to retain an attorney and file a lawsuit. On the other hand, if your whole loss is covered by your insurnace, then having seen to a police report and filed a claim with your insurer, you don't need to do anything else other than answer questions and respond as appropriate.
