What can my penalty be if I was covicted with a DUI in 08/09 and just recently was cited for driving under suspension?
Question Details:
Generally, state statutes provide that any person that is charged with driving with a suspended license where the underlying basis for the suspension is due to a DWI, the state has a mandatory penalty of 30 days or more in jail. There are ways however, to fight the charge. Were you drving as a result of a medical emergency? what was the basis for the stop? if there was no reasonable suspicion to stop you while you were operating the motor vehicle, then you may be able to have the charge thrown out of court becasue your constitutional rights were violated. I would need to see the police report to determine whether there are any defenses. i suggest that you hire a lawyer to assist you here as the penalty is serious.
