Reinstated default divorce

Question Details:

What can I do if I was awarded a default divorce but it was reinstated because my ex filed a answer. We have adult children. My attorney did not let me know about this. He says we have to go to mediation. I paid him and now he wants more money. I make minimum wage. I did not want to go to mediation and he had a new court date set. When I told him I did not have any more money he told me to come and sign papers to release him. I don't know what I'm suppose to do. Do I go to mediation and will I get my divorce on that date ?

This isn't your attorney's fault.  As far as his bill goes, and the request for more money, if he's done all the work you paid him for (which sounds likely), he's not being unreasonable here.  If you don't sign the papers to release him, he'll file a motion and ask the court to let him out of representing you.

Mediation is probably required in all contested cases, which your divorce became once the answer was filed, and I very much doubt that your attorney had any choice about whether or not to set the new court date.
