If I was attacked and was injured, is there any compensation that I can receive?
Question Details:
Was having a private Christmas party at my mom's bar and a man came looking for drinks. I told him we were closed and escorted him to the door. He turned around and hit me out of nowhere. While defending myself 3 bones in my hand were broken. Now I am unable to work until I am healed and will lose out on income. Is there any type of compensation that I can get for this type of "accident"?
based on the limited facts, if someone attacks you, eg. offensive-unwanted-bodily contact, you can sue under civil battery, Also, if someone threatens you with imminent bodily harm, you may have an assault case, generally, if there is battery there is assault as well. In terms of damages, in Tort, which this case would likely be you can prove damages (this is important because it puts a value on your case) And Punitive damages are available in tort. Of course you need to make sure the drunk has money or property or insurance without an intentional acts exclusion. In short your case depends on all of the facts, and should be assessed by a competent lawyer, you can find one by calling your local bar, try Milwaukee Bar if you are in WI.
Also workers comp would cover likily cover the claim, (but it would be a claim against moms bar) feel free to contact me

You could try suing the attacker for assault. He is potentially liable for your medical costs, your loss of income, and any other out of pocket costs directly arising from injuries you incurred in the attack (for example, say you have to hire someone to do things for you that you would normally do yourself, but cannot, while injured). The problem is, given the costs of lawsuits, and the fact that winning is never guaranteed, it may not be worth your while to do this.
