I was arrested on 7/12/2009 for dwi, hired a lawyer, and he has reset my case for the 4th time now stating he does not have the police report. Why?

Question Details: I don't understand why it is going on 3 month's now and I've told my lawyer that I want to plea out, but he keeps resetting the case. He charges me 250.00 every time we go to court and he has done nothing but reset the case. Is he just trying to get more money out of me?

I certainly hope this isn't about your lawyer trying to run up your fee.  Depending on where in Texas you live, $250 might not be unreasonable for the court appearance, if lawyers in that area charge in that neighborhood for an hour's work (and I'd be surprised if the hourly rate is a whole lot less).

The next court appearance should be the last one.  I'd let your lawyer know that ahead of time, ask him to make sure the case is on a "try or dismiss" status, because there's no excuse for the police not providing the report by now (unless your lawyer took two months to get around to asking for it).  I would think that a judge would be on your side, at this point.
