Question: Divorce, Marriage, Alimony - New York

I want to file for divorce. My wife and I have been living separate since Nov 2008, but I dont know where she is. What can I do, so I can relocate?
I was married on Dec 31, 2007. I separated from my estranged wife on Nov 19, 2008. I am not sure where she due to her running from the law. I would like to file for divorce but I am unsure how to do that since she is unlocateable. Last thing I hear was that she left the state. Please advise how I can go about filing for divorce so I can move on with my life.

You have to file a summons and complaint. If you cannot locate her you will need to serve her by legal publication. The maindifference between serving her in person and publication is that publication will take longer to achieve jurisdiction over your wife.
