I settled a case with an oral agreement, but when I read the agreement I realized that I did not understand the term general release What can I do
Question Details: Non parties were included in the general releases including my 25 year old daughter and the corporation owned by myself and my son. Neither were present at the reading or parties to the case. I did not know at settlement that general release meant that I was not only settling this case but would not be able to sue the person for the other legal matters that my attorneys knew I intended. Now I am in contempt for refusing to sign and for my daughter refusing to sign separate genearl releases
I need more facts, but there is no such thing as being in contempt for not signing a release on a civil case. If you have counsel ask them. If not, and you haven't signed, then don't sign and I may be able to help you. Need to know more about the suit. email me at mfeldman@fllitigation.com.
