Question: Criminal Defense - Arizona

Asked on 11/4/2009

How to clear up an out-of-state warrant

I have a driving under suspension ticket in OH that has become outstanding. I live in AZ and was told by OH court that the only way to clear this up is for me to go to go back there. Also, I had been told that I could not get a court appointed at tourney for this problem, is this true?

The general rule is that you have to return to the state that has issued the warrant in order to resolve it.  Moreover, although this is clearly nothing to ignore, it is likely that you will not be able to obtain a public defender for the driving under suspension charge.  However, if you also have a felony "failure to appear" charge, then you may, in fact, qualify for a public defender.  In any event, since you are in AZ, I suggest that you save up the money for a private attorney in OH, and then obtain one as soon as possible so that you can arrange for your peaceful surrender and bond to be posted, in addition to developing a strategy to obtain a favorable resolution of this matter.  Good luck.
