If I recorded a phone conversation between my old boss and myself when he fired me over the phone, can I use that conversation in an unemployment hearing?
Question Details:
My old boss fired me over the phone but told the unemployment agency that I resigned. I recorded the conversation but I didn't tell him it was being recorded. Can I use the tape since I am a party in the call?
Secretly recording a telephone conversation is illegal in Florida. You have no assurance that the tape would be allowed into evidence at an unemployment appeal. In addition, if you disclose the fact that you have taped this converstion you would be risking both criminal and civil penalties.
