I own condo in Florida. Paid the home owners fee for Nov & Ddec 2008. Funds sent back as account for Hoa closed. They charge me $200 late fee

Question Details: I did write the new company that they money was sent back. Right about then my Dad passed away and I was out of the country. On my return I got sick and forgot at that point to resend the funds to the new company. The did not send me a reminder for one year. I am up to date with payments for this year. They applied the funds for this year to the old account and kept adding late payments each time amounting to the $200. It was an oversight on my part as I do have proof of payment in 2008. If the HOA was keeping a check on all units they could have called.

Unfortunately, you have an obligation to pay the HOA fees pursuant to the condominium documents that were given to your dad when he bought the property.  If you want to continue to own the property then you need to continue to make the payments.  you also need to talk to the HPA and explain that ou are not in charge and that all communications need to be directed to you.  provide the HOA with a mailing address and phone number to reach you so that they may keep you informed on a going forward basis.  I would also make arrangements to pay the full amount of the condo fees that are owed to date.  otherwise, the HOA can place a lien on the property and foreclose on it.
