I own a mobile home that sits on a leased lot. If there are dead trees that are dangerously close to falling, who is responsible?
Question Details:
The "rules and regulations" of the park say that the homeowner on whose lot the trees stand is responsible for tree maintenance, but that such maintenance and/or removal of trees and/or limbs requires park approval. I had a tree fall and hit my roof and the park is refusing to have their maintenance personnel remove it from my lot -- they say that it's my responsibility. I wondered if the state laws regarding leasing land says that the tenant is responsible for tree maintenance or isn't that legally the responsibility of the park owner? This doesn't seem fair.
You need to speak to a New Hampshire lawyer. If you do not know one I suggest you call the New hampshire Bar Association and they will refer you. I do not have neough access to the regulations of the park or the laws regarding trees falling in New Hampshire and can not practice law in New Hampshire. Jeremy Howe Newport RI
