What my eviction rights at a barbershop where I rent a booth?

Question Details:

I am a licensed barber and I rent a booth in a shop for 150.00 a week with 8 other barbers. We are not his employees he does not pay us; we pay him. Can he evict us out of his shop that he rents from someone else, without serving each of us proper notice? Especially if he is taking our booth rent and is currently in court for eviction due to not paying his own rent? What would be proper notice? What are our rights since?

The tenat that you rent rent may evict you at the end of each week if he wants.  the reason is becasue you have a week to week lease with the tenant for the use of the booth.  if the tenant no longer wants you there, however, he must go about the eviction propertly.  that means that he should file the eviction notice.  if you fail to leave then he may file a eviction action against you and seek use/occupancy payments and then evict you.  if the landlord of the building wants to evict you, he may similarly do so.  however, simply becasue the tenant is being evicted does nto mean that you can stop paying rent if you are still having the right to use the booths.  if the tenant is evicted, you are likely going to have to leave too.  i suggest that you remain at the property and continue to pay until you receive an eviction notice.  however, it sounds like the tenant is going to be evicted shortly.  therefore, you may want to consider packing up and leaving.
