How do I go about finding the AL Rules of Civil Procedure?
Question Details:
I am a legal assistant and I am drafting a complaint for an automobile accident. I need to know the Alabama Rules of Civil Procedure in order to correctly and legally put this together.
This might get you started. Remeber to watch out for the local rules also. It is a good idea to inquire with the clerk and look at some rpeviously filed complaints for similar cases. They are public records so look and copy what others have filed and use the as exemplars to model your complaint after. The court house usually has form books as well. You should look at any laws cited and make sure they are not out of date.
I found this surprisingly difficult to find on the internet. You're going to have to get a paper copy, and I'd suggest that you start with the attorney that you're working for or with; another alternative would be a trip to the courthouse, or order it on line (I did see what appeared to be a link for that).
You also need to be aware that some of the information you need might be in the statutes instead; if there are any unresolved questions you have after getting and reading the Rules, you should look at Alabama Code, Title 6: Civil Practice.
