I made a purchase and was told by a salesperson that all items I saw were included in the sales price, however, the next day the store decided not to honor the deal; can they do that?
Question Details:
I went to HomeDepot to buy a washer and dryer. I found matching floor models that were on sale. I asked the salesperson if the pedestals the machines were bolted to were included in the price. All of the other machines for sale had that the optional pedestals were an additional cost, however there was nothing about these on the sales tag. The manager on duty decided they were indeed included, so I made the purchase. The next day another manager called and said they were not included in the price. Am I entitled to the pedestals at no extra cost? Do they have to honor the deal the manager made?
A contract is enforceable against a party (i.e. homedepot) where there is a meeting of the mind on clear and definite terms. in this case, you purchased an item after asking a person with apparant authority to answer your question about the price. both you and he (for the store) had an agreement as to what you were to be getting in exchange the purchase price. unless he was mistaken as to what it was that you were buying and you kne the guy made a mistake, then you should be able to bind the store to the sale. the store's manager is at fault for representing the price, not you as you bargained for and paid for the item. i would ignore the calls from the store.
