If I file for a Chapter7 how will that affect my husband my husband's credit/assets if we have no joint accounts?

Question Details:

I live in Idaho and my husband's credit is in good standing and mine is very poor. I am considering filing Chapter 7 for my accounts and he is not on any of them. He has qualified to purchase a home. Can I file after he buys a home? Or how long would we have to wait to file after he buys a home? I am not going to be on the home loan that he qualified for.

If you have separate credit than your filing should not affect your husband's credit/assets in anyway.  In fact, if you have no joint accounts or joint assets, then your bankruptcy will not affect your husband at all.  However, unless you are living apart and are legally separated, in a situation where only one spouse files, the income and expenses of the non-filing spouse is required so that the court, the trustee and creditors can evaluate the household's income.  This, however, in no way obligates your husband, either legally or financially.  Obviously, to the extent you have joint accounts, he will be affected.  The same holds true for any joint assets not exempted by law.
