Basically you have what we call a move away case. Bottom line, I am not going to type everything you need to do on here, but I will tell you this. You need to file a motion for sole custody and a criminal complaint against your husband based on the fact that you are being abused.  The next time you are hit, you need to call the police.  this will help your case as it will show the court that the father is unfit to have kids in his presence and that you are in danger.  The court will initially give you a protective order.  However, you need to make sure that you hire a lawyer to assist you here.   You need to be able to show the court that you have the financial ability to support your child and that your child will not to be displaced.  In other words, the court is going to do what is best for your child - i.e. school is not disrupted.
