I'm being sued by a debt collector, what are my options?
Question Details:
I was contacted by debt collector on behalf of a department store. I asked debt collector by phone and mail to send proof that they were who I should be dealing with. 3 months later I received a response from them on the same day that I received a summons by certified mail, listing GE Money bank as plaintiff and it listed the attorney's name, whom I never heard from. The attorney listed was someone totally different from the debt collector that I contacted.
The most important thing is to make sure you have an Answer filed to the Complaint within the time required by Court. If you know what you are doing you can answer yourself. If not, get a lawyer to represent you. In New Jersey, there is an online guide to Special Civil Part Cases, under $15k, at http://www.judiciary.state.nj.us/prose/10281_spc_guide_court.pdf
I hope this helps!
