Can a 16-year-old choose who to live with?

My 16-year-old wants to live with me in NE. She now lives in CA. Her dad won't let her live with me. there is currently no court order saying who has custody of her. What do I need to do to start the process of filing my own paperwork. I can't afford an attorney.
If there's never been any court order ever entered about your daughter's custody, you have as much right to have her live with you as the father does. So if your daughter comes to visit you, and decides she doesn't want to return to California, you won't be breaking any laws.
If the father doesn't let her come to Nebraska to visit you, that's a good starting point for your custody application. However, you'll need to file your court case in California. I'd recommend trying to find a source for some free legal help, perhaps from a women's rights group, because filing a custody case isn't usually a simple matter.
