I live in Colorado and need to know how many years I have to wait to file bankruptcy again

Question Details:

I filed after my 1 ST divorce and it was discharged in Dec 2002. Now I am going through a second divorce and have to file again because I am disabled and living on a fixed income. I went to a credit consolidator and the payments are too big for me to afford. I don't know what to do. I am getting harassed constantly.

Bankruptcy Law Answers

A debtor cannot obtain a discharge in a Chapter 7 case if the debtor obtained a discharge in (a) a Chapter 7 case filed within the past 8 years, or (b) a Chapter 13 case filed within the past 6 years.

A debtor cannot obtain a discharge in a Chapter 13 case if the debtor obtained a discharge in (a) a Chapter 7 case filed within the past 4 years, or (b) a Chapter 13 case filed within the past 2 years.

The time periods in either case are measured from the commencement dates of the respective cases; the dates of discharge have no bearing.
